Guard End User License Agreement

This End User License Agreement (the “Agreement”) governs your installation and use of Guard. Please read it before purchasing, installing, or using Guard.

Guard presents this Agreement for acceptance before first use. By selecting “I Agree,” or otherwise affirmatively accepting this Agreement through a method provided with Guard, you agree to it. If you do not agree, do not use Guard.

1Definitions

  • “Guard” means the proprietary Windows desktop application developed by the Licensor for creating, managing, verifying, and restoring file snapshots and archives.
  • “Archive” means a storage location created or used by Guard to hold Snapshots, file content, manifests, indexes, catalogs, metadata, or other information used for backup, verification, retention, and restoration.
  • “Snapshot” means a recorded state of files and folders protected by a Guard Job at a particular point in time.
  • “Job” means a Guard configuration identifying protected files or folders, an Archive, and related snapshot or retention settings.
  • “Individual License” means a license granted to one individual. It may be used for that individual’s personal or professional work on computers that individual owns or is authorized and regularly assigned to use, but it may not be shared with or used by another person.
  • “Consumer” means an individual who acquires or uses Guard for purposes outside that individual’s trade, business, craft, or profession, to the extent applicable law treats that individual as a consumer.
  • “Business User” means a user who is not a Consumer.
  • “Licensor” means Dejan Stanojević, who publishes the software under the Albedo One name.
  • “Merchant of Record” means the authorized reseller identified at checkout that sells the license to you and handles the transaction.
  • “Trial” means a time-limited evaluation period during which Guard may be used without a paid license.

2License, not transfer of intellectual property

Guard is licensed, not sold as intellectual property.

Purchasing a license gives you the right to use Guard under this Agreement. It does not transfer ownership of Guard, its source code, license-generation tools, signing keys, build system, brand, trademarks, artwork, or other intellectual property.

The Licensor retains all rights not expressly granted by this Agreement. This does not restrict rights that applicable law gives a lawful acquirer and does not permit the Licensor to avoid any exhaustion, resale, backup, observation, interoperability, or similar rule that cannot lawfully be excluded.

3Proprietary software

Guard is proprietary software. Its source code is not included with an Individual License.

You may not represent Guard as your own work, misrepresent its origin, or distribute Guard under an open-source license that the Licensor has not authorized. Separate open-source components remain governed by their own licenses.

4License grant

Subject to this Agreement, the Licensor grants you a perpetual, limited, non-exclusive license to install and use Guard 1.x under an Individual License.

“Perpetual” means the license itself does not expire for Guard 1.x. It does not mean that Guard will remain compatible with every future operating system, device, filesystem, network, or third-party product, or that downloads and support will remain available forever. Section 7 preserves any update or conformity obligation that applicable law requires.

Unless the purchase terms expressly state otherwise:

  • an Individual License is for one individual;
  • that individual may install and use Guard on any number of computers that individual owns or is authorized and regularly assigned to use, including an employer-owned computer assigned to that individual;
  • the license and license file may not be shared with or used by another person;
  • Guard may be used for that individual’s personal or professional work, including files belonging to an employer or client that the individual is legally authorized to process, provided that Guard and the Individual License are not made available for use by those other persons; and
  • an Individual License may not be used to operate a shared or managed backup service for a team, office, organization, clients, or unrelated third parties.

A permanent transfer of an Individual License is permitted under Section 30.

5Backup copies of Guard and the license file

You may keep reasonable backup copies of the Guard installer and your license file for your own licensed use, including reinstallation and recovery.

Backup copies remain subject to this Agreement. You are responsible for keeping your license file confidential because a person who obtains it may be able to use it.

6Purchases, Merchant of Record, and consumer rights

Guard licenses are sold through Lemon Squeezy, the Merchant of Record identified at checkout. Lemon Squeezy is the seller for the transaction, and its buyer terms govern payment processing, currencies, taxes, invoicing, cancellation, chargebacks, and refunds.

This Agreement governs the license to use Guard. If a Merchant of Record term conflicts with this Agreement on use of Guard, this Agreement controls as between you and the Licensor. The Merchant of Record’s terms continue to control the sale transaction. Neither set of terms excludes rights or remedies that applicable law gives you against the Licensor, the Merchant of Record, or another responsible party.

If you are a Consumer, you retain all mandatory rights concerning pre-contract information, delivery, withdrawal, conformity, updates, repair or correction, price reduction, termination, refunds, damages, complaints, and dispute resolution. Contact the Merchant of Record for transaction and payment matters and the Licensor for Guard functionality and licensing support. Either party may redirect a request when the other is legally or operationally responsible.

7Updates, upgrades, and compatibility

A paid Guard 1.x license includes minor updates that the Licensor releases for Guard 1.x. A major version, such as Guard 2.0, may require a separate license.

The Licensor does not promise to release any particular optional feature, enhancement, or compatibility update. However, this does not limit an obligation under applicable law to supply an update, including a security update, needed to keep Guard in conformity for the period required by law.

When an update needed for conformity is made available, you are responsible for installing it within a reasonable time after receiving clear notice of its availability and the consequences of not installing it. The Licensor is not responsible for a lack of conformity caused solely by your failure to install such an update where applicable law permits that result and the installation instructions were adequate.

You do not have to buy a future major version merely to continue using your licensed copy of Guard 1.x, provided that copy remains technically usable. This sentence does not require the Licensor to preserve compatibility indefinitely.

8Offline operation and manual update checks

Guard is designed for offline use. Normal snapshot creation, browsing, verification, retention, and restoration do not require a Guard account, an Albedo One cloud service, or an internet connection.

Guard does not automatically check for Guard updates or send in-app analytics or telemetry to the Licensor. If you select “Check for updates,” Guard makes a request to the Albedo One update endpoint to retrieve update information. You may choose not to use that feature.

The Windows operating system, installer, security software, certificate-validation services, storage providers, or other third-party components may make network requests under their own settings and policies. Those requests are not Guard telemetry controlled by the Licensor.

Standard technical request data may be processed by the website or update host when you request update information or visit an Albedo One website, as explained in the Guard Privacy Policy.

9Restrictions and statutory exceptions

Except to the extent applicable law expressly permits an activity despite this restriction, you may not:

  • reverse engineer, decompile, or disassemble Guard;
  • modify Guard or create and distribute a derivative software product based on Guard;
  • redistribute, sublicense, rent, lease, share, or publish Guard, a license file, or a license token;
  • allow another person to use an Individual License;
  • split, duplicate, or use an Individual License simultaneously for more than one person;
  • use an Individual License as a shared backup system for a team, office, organization, clients, or unrelated third parties;
  • bypass, disable, tamper with, or work around license checks, Trial limits, signature checks, or licensing mechanisms;
  • misrepresent Guard’s origin or claim ownership of Guard or its intellectual property; or
  • use Guard unlawfully or copy, retain, process, or restore files without the necessary legal rights or permissions.

Nothing in this Agreement restricts a non-waivable right to make a necessary backup copy, observe or test the functioning of software, obtain interoperability information, correct errors, transfer a lawfully acquired copy, or perform another act permitted by applicable law.

10Your files, Archives, and permissions

Your files and Archives remain yours. This Agreement does not give the Licensor ownership of original files, Snapshots, Archives, restored files, filenames, folder paths, manifests, metadata, indexes, catalogs, or other content you create, store, or manage with Guard.

Guard is local-first software. Sources, Archives, and restored files are stored on locations that you select and control, such as internal disks, external storage, removable media, or network storage.

You are responsible for controlling access to those locations and for having the rights and permissions needed to copy, store, process, retain, and restore their contents. The Guard Privacy Policy separately explains data handling.

11Archive confidentiality and encryption

As of this Agreement’s effective date, Guard does not encrypt Archive contents. Unless Guard expressly states that a particular Archive is encrypted, assume that a person or process with access to the Archive storage may be able to read stored file content and metadata.

Use storage with access controls appropriate for the sensitivity of your files. If encryption is required, use suitable operating-system, full-disk, device, volume, or storage-provider encryption and keep recovery keys safely backed up. Guard does not manage those encryption systems or recovery keys.

You are responsible for deciding whether the selected storage location and its security controls are appropriate for personal, confidential, regulated, or third-party information.

12Archive structure and integrity

An Archive may contain file content, manifests, catalogs, indexes, metadata, internal identifiers, temporary files, and other technical information used to identify, verify, retain, and restore Snapshots.

Some components may be rebuildable; others may be required to understand or restore stored content. Do not alter, rename, replace, synchronize, or delete individual files or folders inside an Archive unless Guard’s documentation expressly states that the operation is safe.

Changing an Archive outside Guard may make Snapshots incomplete, inconsistent, unverifiable, or impossible to restore. If you copy or move an entire Archive, you are responsible for confirming that the operation completed and that Guard can open, verify, and restore from the resulting copy.

13Your backup responsibilities

Guard is a backup and snapshot tool. It is not a managed backup service, cloud-storage service, disaster-recovery service, or guarantee against data loss.

You are responsible for:

  • selecting the sources Guard should protect and an appropriate Archive location;
  • ensuring source and Archive locations are available and have sufficient space;
  • reviewing exclusions, errors, warnings, and Snapshot results;
  • protecting Archive storage against loss, theft, damage, malware, unauthorized access, filesystem failure, hardware failure, and accidental deletion;
  • regularly verifying Archives and testing restoration of important files; and
  • maintaining independent copies of important or irreplaceable files.

Do not use a single Guard Archive as the only copy of important data. The appearance of a Snapshot in Guard does not by itself prove that every expected file was readable, included, copied correctly, retained, verified, or restorable.

14Retention, deletion, and destructive operations

Guard may offer retention, Snapshot deletion, Archive cleanup, or other operations that modify or permanently remove Archive data.

When you start or confirm such an operation, or configure a retention rule, you authorize Guard to modify or delete Archive contents according to the settings and selections presented to you. Review retention settings and destructive-operation confirmations carefully.

No warning, confirmation, conservative default, or validation can guarantee that unintended deletion, incomplete cleanup, excess storage use, Archive inconsistency, or data loss will never occur. Operations outside Guard—including manual deletion, synchronization, disk-cleaning tools, security software, malware, filesystem errors, network interruption, device failure, or another user or application—may also damage or remove data.

15Trial and post-Trial access

Guard includes a 30-day Trial for evaluation. The Trial requires no Guard account or payment card.

You may not reset, extend, recreate, bypass, or interfere with the Trial or its technical enforcement.

After the Trial expires without a valid paid license, Guard enters a restricted recovery mode. A valid license is required for licensed modification operations, including creating or editing Jobs, creating new Snapshots, running retention, and deleting protected Job data.

In the supplied Guard 1.x design, Trial expiry does not intentionally block opening a supported existing Archive, browsing available contents and Snapshot information, verifying stored content, or restoring files. This is a product commitment for the Guard 1.x version supplied to you, subject to the technical limitations in Section 16.

The Licensor may change or remove the Trial for a future version, but will not use a later Trial change to retroactively disable the intended browse, verify, and restore access in a previously supplied Guard 1.x version that remains technically usable.

16Restoration

An expired Trial or missing paid license does not intentionally block restoration from an accessible Archive supported by the installed Guard 1.x version. This is not a guarantee that every restoration will succeed.

Restoration may be incomplete or impossible if, for example:

  • the Archive is incomplete, corrupt, damaged, inconsistent, altered, or missing required data;
  • a storage device or network location is unavailable or unreliable;
  • the operating system or another application denies access;
  • the destination lacks space or is otherwise unsuitable;
  • malware, security software, synchronization software, or another process interferes;
  • the installed Guard version does not support the Archive format; or
  • hardware, filesystem, operating-system, or network failure prevents access.

Test restoration of important files periodically and before relying on an Archive as a recovery source.

17Network locations and third-party storage

Guard may access a network location, removable device, external disk, or third-party storage location when you select it as a source, Archive, or restore destination.

The Licensor does not operate or control third-party storage or network services and does not promise their availability, durability, confidentiality, security, performance, pricing, or compatibility. Their separate terms, charges, access controls, privacy practices, retention rules, and technical limits apply.

18Third-party software

Guard may include or use third-party libraries, frameworks, or components governed by separate licenses. Required notices or license information will be included with Guard or made available through the application, installer, documentation, or website.

This Agreement does not restrict rights granted directly by an applicable third-party or open-source license.

19Legal compliance and export controls

You must use Guard in compliance with applicable law. You may not use, export, re-export, or transfer Guard in violation of applicable export-control laws, sanctions, or trade restrictions.

20No high-risk or sole-copy use

Guard is intended for personal and general professional file protection. It is not designed or certified as the sole backup, archive, disaster-recovery, evidence-preservation, regulatory-compliance, medical, emergency, safety-critical, financial-trading, or business-continuity system where failure could cause death, personal injury, major financial loss, legal loss, regulatory breach, or severe damage.

Do not rely on Guard as the only copy or only recovery method where loss, omission, corruption, delayed recovery, or restoration failure could cause serious harm. Use appropriate independent backups, redundancy, verification, tested recovery procedures, security controls, and professional advice.

21Term and termination

The license is perpetual for Guard 1.x unless it is terminated under this section.

The Licensor may terminate the license if you materially breach this Agreement and, where the breach can be remedied, you do not remedy it within 30 days after receiving notice describing the breach. The Licensor may terminate immediately for an irremediable material breach, deliberate license circumvention, unauthorized distribution of Guard or license materials, or unlawful use creating a material legal or security risk.

Termination does not transfer ownership of or intentionally delete your files, Archives, Snapshots, or other locally stored data.

After termination, you must stop all use of Guard except the limited recovery use described below and must delete copies of Guard and license materials that are not needed for that permitted recovery or required by law. Where the supplied version remains technically usable, you may use it only to open, browse, verify, and restore your own files from existing Archives. You may not create Snapshots, create or modify Jobs, run retention, delete Archive data, or otherwise continue ordinary licensed use.

Sections that by their nature should survive termination—including ownership, restrictions, file and Archive ownership, backup responsibilities, warranty rules, liability rules, and governing law—continue to apply.

22Warranties and mandatory conformity rights

22.1 Consumers

If you are a Consumer, Guard is supplied with the legal guarantees and conformity rights required by applicable law. Nothing in this Agreement excludes or reduces a mandatory right or remedy, including a right concerning delivery, conformity, functionality, security, compatibility, updates, correction, price reduction, termination, refund, or damages.

Subject to those mandatory rights, Guard is not promised to be error-free, uninterrupted, immune from every threat, compatible with every file, storage device, filesystem, network, Windows version, security product, or hardware configuration, or suitable for every backup or recovery purpose. Guard is not promised to detect every changed, inaccessible, excluded, corrupt, missing, or unsupported file or to make every Snapshot complete, verifiable, retained for an expected period, or restorable.

22.2 Business Users

If you are a Business User, Guard is provided “AS IS” and “AS AVAILABLE” to the maximum extent permitted by law, without express, implied, or statutory warranties, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, and non-infringement.

The limitations in Section 22.1’s second paragraph also apply to Business Users. Nothing in this subsection excludes a warranty that applicable law does not allow the parties to exclude.

23Limitation of liability

23.1 Rights that are never excluded

Nothing in this Agreement excludes or limits liability or remedies where exclusion or limitation is prohibited, including liability for fraud or fraudulent misrepresentation, intentional misconduct, gross negligence where it cannot be limited, death or personal injury where it cannot be limited, or infringement of a mandatory consumer right.

23.2 Consumers

If you are a Consumer, the Licensor’s liability is not excluded or limited except to the extent applicable law expressly permits. No fee cap or category-of-loss exclusion in Section 23.3 applies to the extent it would restrict a mandatory Consumer remedy.

You remain responsible for taking reasonable steps to limit avoidable loss, including maintaining appropriate independent backups where the need for them is clear and doing so is reasonably possible. This does not reduce a mandatory Consumer remedy.

23.3 Business Users

If you are a Business User, then, to the maximum extent permitted by law:

  • the Licensor is not liable for indirect, incidental, special, exemplary, punitive, or consequential loss, or for loss of profit, revenue, business opportunity, goodwill, or expected savings; and
  • the Licensor’s total aggregate liability arising from Guard or this Agreement is limited to the amount paid for the applicable Guard license.

Loss or corruption of files, Archives, Snapshots, or other data is subject to the aggregate cap but is not automatically characterized as indirect or consequential loss. The exclusions and cap do not apply to liability listed in Section 23.1.

24Third-party claims

If you are a Business User and your unlawful use of Guard, unlawful processing of files, unauthorized distribution of Guard or license materials, or material breach of Section 9 causes a third party to bring a claim against the Licensor, you will indemnify the Licensor for reasonable, finally awarded damages and reasonable external legal costs arising directly from that claim.

The Licensor must notify you promptly, allow you reasonable control of the defense and settlement, and provide reasonable cooperation at your expense. You may not settle a claim in a way that admits fault by or imposes a non-monetary obligation on the Licensor without written consent.

This contractual indemnity does not apply to Consumers. Consumers remain responsible under ordinary applicable law for loss they unlawfully cause.

25Changes to this Agreement

The Licensor may publish different terms for a future version of Guard. The Agreement you accepted continues to govern the Guard 1.x license supplied under it unless:

  • you affirmatively accept replacement terms;
  • a change is required by law, in which case it applies only to the extent required; or
  • the change is a clarification or security-related change that does not materially reduce an existing right or the licensed functionality promised to you.

No change will retroactively remove the perpetual Guard 1.x license, included released minor updates, or the intended recovery access described in Sections 15, 16, and 21.

26Governing law and disputes

This Agreement is governed by the laws of the Republic of Serbia, without applying its conflict-of-law rules.

If you are a Consumer, this choice does not deprive you of mandatory protections of the law that would apply without this choice, and it does not require you to bring a claim in Serbia if applicable law gives you the right to use the courts or dispute-resolution bodies of another place.

Before starting formal proceedings, either party may contact the other at the address in Section 32 and make a reasonable attempt to resolve the matter. This does not suspend a limitation period or require a Consumer to use informal or alternative dispute resolution before going to court. Any mandatory right to lodge a complaint or use an out-of-court consumer dispute process remains available.

If you are a Business User, the courts with subject-matter jurisdiction in Belgrade, Serbia have exclusive jurisdiction over a dispute arising from this Agreement, to the extent such a choice is legally permitted.

27Relationship with other terms

This Agreement and any license scope expressly stated at checkout form the agreement between you and the Licensor concerning use of Guard.

The Merchant of Record’s buyer terms separately govern the sale transaction. The Guard Privacy Policy, published at https://guard.getalbedoone.com/privacy.html, explains personal-data handling and does not reduce rights under this Agreement or applicable data-protection law.

If documents conflict, they control only within their stated subject: checkout license scope controls the purchased edition or quantity, this Agreement controls use of Guard, Merchant of Record terms control the transaction, and mandatory law controls over all of them.

Language versions. This Agreement is published in English and in Serbian. The two versions are intended to have the same meaning and the same legal effect. If a difference in meaning appears, the version in the language in which the Agreement was presented to you before purchase or acceptance applies to you. Nothing in this paragraph reduces a mandatory right to receive information or contract terms in a particular language, and a language clause is not used to deny a Consumer a right available under the Serbian version.

28Severability

If a provision is invalid or unenforceable, it will be limited or removed only to the minimum extent permitted by law. The remainder continues in effect if it can operate without that provision. A court is not asked to rewrite an unfair Consumer term more broadly than applicable law permits.

29No waiver

A failure or delay in enforcing a provision on one occasion is not a waiver of the right to enforce it later.

30Assignment and permanent transfer

You may permanently transfer a purchased Individual License to another person without a transfer fee or advance permission, provided that:

  • you transfer the license as a whole and do not retain or create a second usable license;
  • you stop using Guard under that license;
  • you delete or render unusable your license credentials and any copies retained only for your licensed use;
  • you give the transferee this Agreement and any license materials reasonably needed to use the transferred license; and
  • the transferee accepts this Agreement before using Guard.

You may not split, temporarily lend, rent, sublicense, or repeatedly circulate the license. This section does not restrict a broader transfer right that applicable law requires.

The Licensor may assign this Agreement as part of a sale, transfer, or reorganization of the Guard business only if the assignee assumes the Licensor’s obligations and the assignment does not reduce rights under a valid license.

31Support and complaints

For ordinary product support, the Licensor will use reasonable efforts to respond by email and to investigate reproducible problems. This is not a service-level agreement and does not promise a fixed response or correction time. Response times may vary depending on the nature and complexity of the issue.

This does not limit any mandatory deadline or remedy that applies to a Consumer complaint, lack of conformity, security update, refund, or other legal claim. Complaints should identify the purchase, the problem, and the remedy requested where reasonably possible.

Formal complaints may be submitted by email, post, telephone during the published telephone hours, or another method required by applicable law. Where required, the Licensor will record the complaint, confirm receipt or provide a reference number, and respond within the legally applicable period. The separate Complaints Procedure describes this process and the available out-of-court dispute resolution.

Email is the preferred contact method. The address above is the geographic address for customer and legal communications. Any additional identity, complaint, or alternative-dispute-resolution information required by the law applicable to a sale must also be provided before purchase and on the relevant website or checkout record.

Plain-English summary

This summary is for convenience. The numbered Agreement controls if the two conflict.

  • A paid Individual License is perpetual for Guard 1.x and is for one person, who may use it on any number of computers that person owns or is authorized and regularly assigned to use.
  • A purchased Individual License may be permanently transferred as a whole, but it may not be duplicated or used by both people.
  • Minor Guard 1.x updates that are released are included. Mandatory conformity and security-update rights are preserved.
  • Guard is local-first. It does not automatically check for Guard updates or send Albedo One in-app analytics or telemetry.
  • Guard Archives are not encrypted by Guard as of the effective date. Use appropriate storage security and encryption.
  • Your files and Archives remain yours.
  • Guard is a backup tool, not a guarantee against data loss. Keep independent copies and test restoration.
  • Do not manually change files inside an Archive unless Guard’s documentation says the operation is safe.
  • Retention and deletion operations can permanently remove Archive data.
  • The Trial lasts 30 days and requires no account or payment card.
  • Trial expiry, a missing license, and termination do not intentionally delete user data or block browsing, verification, or restoration from a supported existing Archive in the supplied Guard 1.x version.
  • Consumers retain all mandatory conformity, update, remedy, liability, court, and dispute-resolution rights.
  • “AS IS,” the fee cap, and the contractual indemnity apply only to Business Users and only as far as the law permits.
  • Statutory software backup, study, interoperability, and transfer rights are not restricted.
  • The English and Serbian versions are intended to mean the same thing; the language version presented to you before purchase applies to you.
  • Support is by email using reasonable efforts, with no guaranteed response time. Formal complaints follow the separate Complaints Procedure.
  • Do not share a license, bypass licensing, redistribute Guard unlawfully, or use Guard without rights to the files involved.
